Quick Overview
Out of the Cave Food (“we”, “our”, “us”) provides freshly prepared meals and meal-prep services delivered or available for pickup throughout select areas of the Bay Area. By creating an account, placing an order, or using our website, app, or services (collectively, the “Services”), you agree to these Terms of Service.
Please read them carefully, especially information about order cutoffs, cancellations, refunds, delivery, and food safety.
1. Ordering & Cutoff Times
We operate on a weekly ordering cycle so we can purchase fresh produce and meats based on your selections.
- Our standard order-by cutoff is Thursdays at 10:00 PM (Pacific Time).
- After the cutoff, your order is locked in and we begin placing ingredient orders and scheduling production.
- Cutoff times may change during holidays or special events; any changes will be announced on our website, app, or via email/text.
2. Cancellations & Refunds
2.1 Before the Cutoff (Thursday 10 PM)
You may change, cancel, or request a refund for your order any time before the weekly order cutoff (usually Thursdays at 10 PM Pacific Time).
Approved refunds will be issued to the original form of payment unless otherwise noted.
2.2 After the Cutoff
Once the order-by date/time has passed, we have already begun purchasing ingredients and planning labor based on your order. For this reason, orders cannot be canceled, changed, or refunded after the cutoff.
This policy applies to both one-time orders and subscription orders unless explicitly stated otherwise in a special promotion.
3. Delivery, Pickup & Food Safety
We prepare and deliver your meals fresh. Because of this, proper handling after delivery is essential for food safety.
3.1 Refrigeration Requirement
Once your meals are delivered or picked up, you are responsible for refrigerating your food as soon as you receive it. Meals are transported in cooler bags with ice, but they are always fresh and must be kept refrigerated thereafter.
3.2 Delivery Notifications & Driver Actions
As part of our service, we make reasonable efforts to let you know when your order is on its way and when it has arrived. However, some parts of this process depend on third parties (such as mobile carriers).
- We may send text messages and/or app notifications when your delivery is en route and upon arrival.
- We cannot guarantee that you will receive a text message, as this can be affected by phone carriers and technical issues outside of our control.
- Our drivers will make a reasonable attempt to either knock on your door, send a text through our app, or both, when they deliver your order.
- If you leave a comment at checkout asking us not to knock, those instructions override our default behavior.
Important: Once a delivery has been dropped off at the address you provided and confirmed by our driver (for example by route system confirmation, photo, or timestamp), the order is considered fulfilled. We cannot guarantee the safety or quality of food that is left unrefrigerated, brought indoors late, or otherwise mishandled after delivery.
3.3 Incorrect or Incomplete Addresses
Please ensure that your delivery address, gate codes, and any special instructions are accurate and up to date. We are not responsible for delays or non-delivery due to incorrect or incomplete information provided by the customer.
4. Subscription Orders
If you enroll in any recurring or subscription plan:
- Your payment method will be charged automatically according to the subscription schedule.
- You must make any changes, skips, or cancellations before the weekly cutoff (usually Thursday at 10 PM) for them to apply to the upcoming order.
- Canceling a subscription stops future renewals but does not cancel orders already placed after the cutoff.
5. Allergies & Dietary Preferences
We make a strong effort to accommodate various dietary lifestyles and preferences (such as paleo, keto, gluten-free, and more). However, our kitchen may handle common allergens, and we cannot guarantee an allergen-free environment.
By placing an order, you acknowledge and accept that there is always some risk of cross-contact, and you agree to review ingredient lists carefully and use your own discretion, especially if you have severe allergies or medical conditions.
6. Pricing, Menu Changes & Availability
All prices, fees, menus, and offerings are subject to change at any time without prior notice. Because we work with fresh, seasonal ingredients, certain items or customizations may become temporarily unavailable.
7. Accounts & Acceptable Use
When you create an account with us, you agree to:
- Provide accurate, up-to-date information.
- Keep your login credentials secure and not share your password.
- Use the Services only for lawful purposes and in accordance with these Terms.
- Not attempt to interfere with, reverse-engineer, or otherwise misuse our systems or platform.
8. Limitation of Liability
To the maximum extent permitted by law, Out of the Cave Food and its owners, employees, and contractors are not liable for:
- Any spoilage, quality issues, or food safety concerns arising after your order has been delivered or picked up;
- Theft, loss, or damage of orders after delivery;
- Missed SMS notifications due to phone carrier issues, spam filters, or technical failures outside our control;
- Delays or failures in delivery caused by weather, traffic, accidents, natural disasters, or other events beyond our reasonable control;
- Any adverse reactions, health issues, or consequences resulting from ingredients, allergens, or your personal health conditions.
In any case where we are found liable, our total liability will not exceed the amount you paid for the specific order in question.
9. Changes to These Terms
We may update or revise these Terms from time to time. When we do, we will post the updated version on our website with a new “Last updated” date. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
